Terming the Central Bureau of Investigation (CBI) as biased, the Karnataka government on Thursday decided to withdraw the general consent given to the agency to investigate cases in the state. State Law and Parliamentary Affairs Minister HK Patil informed the media about the decision after the state cabinet meeting chaired by Chief Minister Siddaramaiah. Patil said the notification granting general consent to the CBI to investigate criminal cases in the state of Karnataka under the Delhi Special Police Establishment Act, 1946 has been withdrawn.
The minister said that we have decided that the blanket decision to allow CBI has now been withdrawn and we will consider it on a case-by-case basis. The Cabinet was wise to remain cautious. He said that we are expressing our concern about the misuse of CBI. In all the cases we have handed over to CBI, they have not filed charge sheets, due to which many cases are pending. They have also refused to investigate many of the cases sent by us. There are countless such examples. They are biased. That’s why we are taking the decision. This is not because of MUDA issue. We have taken this decision to stop them (CBI) from adopting the wrong path.
Deputy CM DK Shivakumar said that not only Karnataka, all the opposition parties across the country have taken this decision, keeping this in view the Karnataka government has also taken this decision. We do not want CBI to misuse its power. Let us tell you that according to Section 6 of the Delhi Special Police Establishment (DSPE) Act, 1946, the Central Bureau of Investigation (CBI) requires consent from the concerned governments to conduct investigations within the jurisdiction of the state governments.
