The Bombay High Court on Wednesday ordered all case papers to be handed over to the state CID after Akshay Shinde’s father filed a plea in the Badlapur incident. The High Court questioned why the files have not been handed over to the CID yet? The court said that though it is not expressing any doubt at this stage, it is very hard to believe that Akshay Shinde snatched a pistol from a police officer and opened fire. The High Court said that the encounter death of Akshay Shinde, accused in the Badlapur sexual assault case, should be investigated in a fair manner. The court said that if the police had tried to control Shinde first, the firing could have been avoided and it is very difficult to believe that he snatched the pistol from a police officer and opened fire. The court asked why the accused was shot directly in the head instead of the hand or leg first? A division bench of Justice Revati Mohite Dere and Justice Prithviraj Chavan said that if it finds that the investigation is not being done properly, it will be forced to pass appropriate orders.
Shinde, 24, was accused of sexually assaulting two minor girls at a school in Badlapur town of Thane district in Maharashtra. According to police, Akshay Shinde was being taken from Taloja jail in Navi Mumbai to Badlapur in a police vehicle in connection with the investigation of an FIR lodged by his ex-wife. During this, he allegedly snatched the pistol of a policeman near Mumbra bypass in Thane, after which he died in the firing.
