The Supreme Court dismissed the West Bengal government’s appeal against the Calcutta High Court order directing a Central Bureau of Investigation or CBI probe into allegations of land grabbing and sexual harassment in Sandeshkhali. A bench of Justices BR Gavai and KV Vishwanathan said why should the state be interested in protecting anyone? On the last date of hearing, the counsel appearing for the West Bengal government said the matter should be adjourned after the apex court said so. The bench said, “Thank you.” The apex court was hearing a plea by the state government challenging the Calcutta High Court’s April 10 order.

Hearing the petition on April 29, the Supreme Court asked the West Bengal government why the state should come as a petitioner to protect the interests of some private individuals. In its petition before the apex court, the state government said that the order of the Calcutta High Court has demoralized the entire state machinery, including the police force. The case of attack on Enforcement Directorate (ED) officials in Sandeshkhali is already being investigated by the CBI and three FIRs have been registered related to the January 5 incidents.

Noting that the investigation will be monitored by the court, the Calcutta High Court directed the CBI to file a comprehensive report on the alleged illegal conversion of agricultural land into water bodies for fish farming after conducting a thorough inspection of the revenue records and physical inspection of the land that has been allegedly converted. The High Court also directed the CBI to investigate the allegations of crime against women and land grabbing in Sandeshkhali and submit a comprehensive report on the next date of hearing.
