The court found that the name of Arif Hussain is written on the Aadhaar card of the accused filed with the petition, on this the court asked the lawyer of the accused that if he has adopted Sanatan Dharma then why his name is still Arif Hussain.

Lucknow. The Muslim youth who run Mission Love Jihad under the guise of Islam keep adopting new tactics to escape from the eyes of the police and judiciary. These people do not desist from misleading even the High Court. In this sequence, the Lucknow bench of Allahabad High Court has rejected a petition challenging the FIR registered on the charges of marriage by hiding religion and misconduct. In this case of Love Jihad, the accused and the so-called husband said that he had left Islam and adopted Sanatan Dharma 15 years ago in the year 2009, after which he married the victim in the Arya Samaj temple. Although the court found that the name of the accused is written on the Aadhaar card filed with the petition, the name Arif Hussain was written. On this, the court asked the lawyer of the accused that if he has adopted Sanatan Dharma then why his name is still Arif Hussain. When the accused’s lawyer could not give any satisfactory answer to this, the court rejected the petition and also gave the police the freedom to investigate whether the accused had made any mistake by making an Aadhaar card in the name of Arif Hussain. He has also committed other crimes because he had converted to religion in 2009 itself.

This order has been passed by the division bench of Justice Vivek Chaudhary and Justice NK Johri on the petition of Arif Hussain alias Sonu Singh and others. On behalf of the petitioners, challenging the FIR of the case registered on 9 September 2024 at Sushant Golf City police station, it was argued that the marriage of petitioner number one and the victim was solemnized on 24 January 2009 at Arya Samaj Mandir, Aliganj. Before the said marriage, on the same day, petitioner number one had converted to Sanatan Dharma. It was said that after 15 years, the victim has lodged the present FIR alleging that the petitioner number one married her after hiding her religion and raped her. It was also argued that there was actually a marital dispute between them and an FIR was lodged under the guise of misbehavior and hiding religion. Opposing the petition, the state government’s advocate said that the allegations made in the FIR are serious and hence it cannot be rejected.
